Foreign Investment
Australia’s stable political and economic environment and strong rule of law, its business potential (especially in resources and service industries), its position at the base of Asia and its lifestyle appeal make it an attractive place for foreign nationals to invest. Such investment is regulated in the national interest by the Treasurer through the Foreign Investment Review Board.
But what is a foreign national? What industries are covered? How do the rules apply to real estate? How is the national interest assessed?
We provide foreign investors with advice on how the Treasurer’s regulations and policies will apply to their investment proposals. This requires analysis of company structures to clarify their foreign status and nationality; consideration of different sectoral policies; understanding how threshold limits work; and using special preferences available to US investors. If a proposal is notifiable, the deal involved must be simply and clearly explained to FIRB and any questions must be dealt with confidently and capably.
